  • Building permit threshold. The Virginia Uniform Statewide Building Code exempts retaining walls supporting less than three feet of unbalanced fill from permit application. The exemption does not apply to walls impounding Class I, II or III-A liquids, or to walls supporting a surcharge other than ordinary unbalanced fill.
  • Land disturbance. Land-disturbing activity is regulated at 10,000 square feet generally, and at 2,500 square feet in areas designated as Chesapeake Bay Preservation Areas. Localities are permitted to set lower thresholds than these.
  • Chesapeake Bay Preservation Act buffers. Designated Tidewater localities apply Resource Protection Area buffers along waterways. This does not apply uniformly across our service area, which is exactly why it is worth checking rather than assuming.
  • Virginia 811 notice. Required before excavation under the Underground Utility Damage Prevention Act. The marking period runs to 7:00 AM on the third working day after notice. Marks must be preserved, tickets updated past 15 days, and hand digging used within two feet of a marked line. Private lines are not marked and are the property owner's to identify.

When Engineering Enters the Picture

  • Height. As walls get taller the consequences of getting the design wrong grow quickly. Most localities set a review trigger at a stated height, above which stamped drawings are required.
  • Surcharge. Vehicle loads, structures and pool decks above a wall change it from a landscape element to a loaded structure. Engineering is common regardless of height.
  • Tiered walls. Tiers too close together mean the upper wall surcharges the lower one. Spacing determines whether they behave as two walls or one tall one, and that is a design calculation.
  • Slope above or below. A slope continuing up behind the wall, or falling away below it, changes the loading and the stability analysis.
  • Repeat failure. A wall that has already been repaired and moved again is telling you the original design was inadequate. That is an engineering question.
  • Commercial work. Site plan review, stamped design and inspection are standard on commercial and multifamily projects rather than exceptional.
